NYS PTET Election Instructions
1) Login to your NYS online business account.
2) If you've forgotten your username or password for your online account, use the 'Forgot Username' and/or 'Forgot Password' options. If you still can't log in after trying these steps, call the NYS Online Help Center at 518-485-6027, select option 2, then option 4, for assistance with accessing your account.
3) Once you are logged in and on the Account Summary page, click on the ≡ Services menu located in the upper-left corner.
4) Under the "Services" heading, select "Corporation tax," and then select "PTET web file" from the expanded menu.
5) Select the first option "Pass-Through Entity Tax (PTET) Annual Election".
6) Fill out the requested information for the authorized person (should be the owner of the company).
7) Scroll down to the Election Information section and select from the following choices.
Partnership - Select this option if your business operates as a Partnership,
Resident S Corporation - Select this option if your business operates as an S Corporation and was incorporated in New York State.
Standard S Corporation - Select this option if your business operates as an S Corporation and was not incorporated in New York State.
8) Scroll down and Answer Yes to the New York State acknowledgement
9) Scroll down to the New York City acknowledgement section. Check "Yes" to make the New York City Election, if any of the following apply: Otherwise, check "No".
- Your business is an S corporation and all shareholders are New York City residents.
- Your business is a partnership and it has at least one partner or member who is a New York City resident.
10) Verify that the physical business address is correct. If necessary, fill in your updated address. Then indicate whether the mailing address is the same as the physical address by selecting "Yes" or "No". Then, press continue to proceed.
11) Scroll to the bottom of the page and click on the "Submit" button to complete the PTET Election.
12) Click on "View/Print Form" to save the Filing acknowledgement.
13) email service@spearcpa.com either the saved filing acknowledgment or forward the email from NYS confirming the NY PTET Election.
